Terms of Service
Effective Date: March 31, 2026 · Business Name: Scholar Pools · Service Area: Florence, Arizona
1. Services Provided
Scholar Pools provides weekly pool maintenance including debris removal, brushing, basket emptying, vacuuming as needed, water testing, and chemical balancing.
This service is for ongoing maintenance only and does not include repairs, restoration, or recovery of neglected pools.
2. Billing & Payment
Service is billed at $100 per month on an automatic recurring basis to the card on file.
Service is intended to be ongoing. Customers may cancel anytime.
Cancellations within the first 90 days of service incur a $150 early termination fee to cover initial setup, chemicals, and route onboarding.
3. Independent Contractor Status
Scholar Pools coordinates services performed by independent student contractors. These individuals are not employees, agents, or representatives of Scholar Pools.
4. Minor Worker Disclosure
Some independent contractors performing services may be under 18 years of age. By agreeing to service, the customer acknowledges and consents to minors entering the property solely to perform scheduled pool maintenance.
5. Customer Access Requirements
On scheduled service days, the customer agrees:
- Gate access is unlocked
- Pets are secured
- Proper pool water level is maintained
- Pool equipment is powered on and operational
Failure to meet these conditions releases Scholar Pools from responsibility for completing that visit.
6. Safe Premises Requirement
Customer agrees the property is safe for entry and free from hazards including slippery surfaces, loose pets, broken gates, exposed wiring, or unsafe equipment areas. Scholar Pools is not liable for injuries caused by unsafe property conditions.
7. Missed Service Days
No refunds or credits are issued for missed visits due to access issues, unsafe conditions, or equipment being off.
8. Chemicals
Standard weekly chemicals are included. Excess chemicals required due to algae, storms, neglect, or abnormal conditions are billed separately.
9. Green / Algae Pools
Pools in green, algae-filled, or neglected condition require a paid cleanup before weekly service begins. Scholar Pools may refuse service based on pool condition.
10. Extra Services
Filter cleanings, storm cleanups, excessive debris removal, and services outside weekly maintenance are billed separately.
11. Equipment & Pre-Existing Issues
Scholar Pools is not responsible for pre-existing equipment failure, leaks, cracks, structural issues, or damage caused by weather, animals, or third parties.
12. Release of Liability
Customer agrees that Scholar Pools, its owners, and independent contractors are not liable for:
- Damage to aged or fragile equipment during normal handling
- Surface wear to plaster, tile, decking, or coping
- Injury to unsecured pets
- Water chemistry issues caused by customer interference between visits
- Injuries sustained by contractors while on the property
13. Property Surveillance & Recording
Customer acknowledges that exterior cameras or surveillance systems may record service visits and agrees such recordings may be used for safety verification or dispute resolution.
14. Right to Refuse or Terminate Service
Scholar Pools may refuse or discontinue service due to unsafe conditions, non-compliance, or inappropriate behavior.
15. Acceptance of Terms
By purchasing service or checking the agreement box at checkout, the customer agrees to these Terms.
